PEARL RIVER, NY — A major accident sent one person to the hospital with head injuries in Peal River, New York on Tuesday, April 8th, 2014, according to a news report from Lower Hudson News.
Investigators from the Pearl River Police Department have said that they believe an unidentified man was hurt when they were struck by a transit bus while walking along or trying to cross the street at the intersection of North Middletown Road and East Central Avenue.

One person was taken by EMS personnel to a nearby hosptial where they were last listed in critical condition by a hospital spokesperson.
The investigation into the crash is being handled by officials from the New York State Police.
Commentary:
It’s always unsettling to hear so many people say ‘the pedestrian always has the right of way’, because not only is this incorrect, but it is dangerous information to give people. Unless you are in a parking lot, or in a crosswalk protected by a signal, pedestrians rarely have the right of way. The exception to this rule comes when vehicles are turning. Whenever a car is stopped at an intersection, and about to make a turn, the driver has a duty to make sure the path that they are turning into is both clear and safe. If the driver in this case was coming off a stop attempting a turn, and failed to make sure the turn was safe and clear, the bus company could be held accountable for the accident if all the facts line up.
