Commentary:
Whenever an accident where a tractor-trailer has rear-ended a vehicle comes across my desk, all I see is just how preventable the accident was. Truck drivers are trained extensively on road safety, and this includes the necessary precautions of tailoring their speed and following distance in order to prevent an accident. If the truck was found to have been speeding, or the driver didn’t give himself enough room to stop and collided with the truck, the trucking company may be held accountable for the accident if the facts pan out. But never have I seen a trucking company simply admit fault, it is actually more worth it for them to just fight the claims and draw the case out over time in order to wear down the other side, versus simply accepting responsibility for the accident.
