Commentary:
Many people are unaware of how the inclusion of alcohol can effect the outcome of an investigation. In the State of Texas, we have a set of liquor liability laws that oversee the reasonable and safe sale of alcohol at places like bars, restaurants, liquor stores, and nightclubs that prevent people from selling alcohol to already drunk customers, and prevent selling alcohol to customers to the point of obvious intoxication. These are known as ‘dram shop laws’, and are often unpopular with both bars and the people that visit them. Many people see it as unfair, but my question to them is “is it reasonable or safe for a bar to serve a customer 20 shots within two hours?” If the driver of the car is found to have been over-served after an accident, the bar they came from could be held accountable if they are found to have violated dram shop laws when they were serving them.
