Worker Injured in Dump Truck Accident in Longview, TX


Longview, TX — There was an accident in the area of Whitney and Neal Streets in Longview, Texas, on Wednesday, April 2. A mechanic was working on a dump truck with a raised bed. The bed fell on the man, pinning him down. Longview firefighters responded to the accident and were able to free the man. He was taken to Good Shepherd Medical Center for the treatment of his injuries. His condition is currently unknown.

At this time, what caused the bed of the truck to fall on the man is currently unknown.

Details on this one are a little dry, but it’s probably not a bad assumption to make that workers’ compensation is going to come up sooner or later. So let’s a moment to explain what the means for the worker who was injured. If the dump truck that pinned him down belonged to the company he was working for, and there was nothing malfunctioning with it, or whoever was manning the controls that operated the bed was responsibly doing his job, this would fall under workers’ comp. That means that the employee doesn’t have any legal recourse against the employer. Now, that makes quite a few assumptions. These sorts of cases aren’t always to clear cut. If there was something wrong with the truck, some sort of mechanical problem that shouldn’t have occurred, then the workers’ comp gross negligence clause may come into play here. Another possibility may be that the truck was owned or being operated by a third party. In that case, generally speaking, the injured employee would have a means of legal recourse. Again, this is all hypothetical, as details here are a little sparse.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
