Commentary
Pedestrian accidents require an investigation to determine where each party was located and in particular the victims location to the roadway. This is because Texas operates under the policy of comparative fault meaning every involved partys actions will be scrutinized for liability. In most situations fault is proportionally spread between parties with the degree here affecting what civil options are available to a victim or their survivors.
