Commentary:
Whenever alcohol is suspected in an accident that takes place around 2:00 in the morning, I cant help but wonder if a bar was involved. Why does this matter? Texas has a set of liquor liability laws that govern the responsible service and sale of alcohol at restaurants, bars, nightclubs and liquor stores. Essentially, each of these licensed providers of alcohol promised to the state that they will not serve alcohol to somebody who is already visibly drunk, they promise not to serve underage customers, and they promise not to serve somebody to the point of obvious drunkenness.
If any driver has come from a bar that has violated these laws, the establishment can and SHOULD be held accountable for the accident alongside the driver. Only when drunk drivers and the bars that irresponsibly serve them are punished equally can we seriously address the drunken driving problem gripping the state.
