UPDATE: Thomas Smart Killed in Dump Truck Accident in Lillington, North Carolina

LILLINGTON, NC — A collision between a sedan and a tractor-trailer left one driver dead in Lillington, North Carolina on Wednesday, March 26th, 2014, according to a news report from The Fay Observer.

Police have said that they have reason to believe Thomas Smart was killed when the Nissan he was driving crossed into the lanes of oncoming traffic unexpectedly and collided head-on with a dump truck while driving on highway 401 around 6:00 in the morning.

Scene of the Accident

Thomas Smart was killed in the crash, although the report does not clarify if he was killed instantly in the crash, or if he was taken by EMS personnel to a nearby hospital where he died a short time after his arrival.

The investigation is currently ongoing by representatives from the North Carolina State Police, who expect to release the findings of their investigation at a later date.

Commentary:

Many people would see a fact pattern like this and call the accident unavoidable, but I’m here to show you how to look at things from another angle. Keeping in mind that I’m not saying this is how it happened, but what if the truck driver was speeding at the time of the accident. This may not have stopped the vehicle from skidding across the road, but it may have softened or averted the collision altogether. In the same vein if the driver was distracted on his phone, he may have missed his only opportunity to apply the brakes to avoid the vehicle. While there is always a chance I am wrong, just remember that passing judgment based on a cursory news article may be jumping to conclusions.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
