Commentary:
Many people I have run this accident by have said that they would fault the rear driver based on the news article, but there are a few details missing from the report. What I’m wondering is, “was the U-turn the driver was trying to make legal? Did he have the right of way? Was he stopped appropriately in the road before the crash?” These are all potential factors that could shift the liability of this accident onto the other driver if the facts line up. Simply jumping to conclusion based on a news article written by somebody who did not witness the accident may not give an accurate opinion on what really happened in the crash. While there is a chance that this accident was caused by driver inattention, assuming that off the bat from a news article would be hasty at best.
