Commentary:
Whenever these kinds of accidents happen with people so young, the driver and passenger are usually very familiar with one another, and things tend to get very, very sensitive. So instead of dissecting the minutiae of this accident, lets just take a step back and look at passengers rights in single vehicle accidents. From a legal perspective, passengers rarely, if ever bear fault in accidents. Simply put, they have no control over the vehicle, or what it does, so more than likely, the driver will bear fault long before the passenger ever will. Passengers usually have the most valid claims in accidents, for no other reason than the fact they usually had nothing to do with how the accident happened.
