Commentary
Accidents just like this one happen every day, all over the country. Accidents in which who’s at fault seems to be pretty obvious. However, many people don’t know that despite liability being clearly established in an accident, an at-fault party has no legal obligation to “make things right” with the person they’ve run into. People tend to think that if they’re ever hit in an accident, they’re owed a certain amount of compensation. This isn’t true. An insurance carrier has a legal obligation to defend their client. Remember, an insurance carrier’s best interests rarely line up with the best interests of a victim. They’re only going to be persuaded to help a victim if they think that being taken to court is going to be more expensive for them. That’s not to say that courts and juries have to get involved anytime an accidents occurs, but it’s helpful to remember that an insurance carrier isn’t there to represent your interests.
