SAN ANTONIO, TX — Both Leo Gutierrez, Krystina Gutierrez were hurt in an accident with an alleged drunk driver in San Antonio, Texas on Saturday, August 9th, 2014. The article from KSAT said that the accident happened around 3:00 Saturday afternoon.
Leo Gutierrez, and his sister Krystina Gutierrez were seriously hurt when the donkey-drawn wagon he was a passenger in was hit by a pickup truck at the intersection of Pearsall Road and Kearney Road. Police believe the pickup truck hit the back of the donkey cart, and nearly drove completely over it.
The pickup truck fled the scene after the accident.
Leo and Krystina Gutierrez were taken to the hospital after the accident for treatment of their injuries. Leo sayed in the hospital for nearly three months following the accident.
The driver of the pickup truck was later identified as Javier Munoz, who currently faces five counts of intoxication assault in connection with the crash.
The San Antonio Police handled the accident investigation.

Commentary:
This accident saw five people hurt, and put a boy in the hospital for months. This means that the medical bills alone in this accident could far outweigh the maximum policy limits of the offending driver, but is the driver’s insurance the only party to make a claim against? I can’t say for sure, but considering the majority of drunk drivers in accidents I handle became intoxicated at bars and restaurants, the liquor license holding business that failed to serve alcohol safely and responsibly as the law permits could also be held accountable for the accident right along side the drunk driver. Why should a drunk driver be the only one punished in an accident like this if over-serving is just as illegal as drunk driving?
