Pablo, MT — Police have identified Andre Dullinger as the man killed in an accident with a flatbed trailer near Pablo, Montana, on Tuesday, September 23, 2014. The accident happened on Highway 93, late in the afternoon.
Reports say that Dullinger was traveling north along Highway 93 when the trailer pulled out on the road ahead of him. Dullinger wasn’t able to stop and crashed into it. The collision pushed him into the guardrail.
There’s been no word on the truck driver. Police are investigating the accident.

I think a lot of people’s first response after seeing an accident like this would be that the truck driver was definitely in the wrong. He shouldn’t have pulled out into the road that close to an oncoming car. Case closed. In a perfect world, that would be it. However, a perfect world this is not, and I can tell you that following an accident, a trucking company is going to have a prepackaged defense for every eventuality that they’ll be able to trot out and use to defend their case.
