Andre Dullinger Killed in Flatbed Trailer Accident on Highway 93 Near Pablo, MT


Pablo, MT — Police have identified Andre Dullinger as the man killed in an accident with a flatbed trailer near Pablo, Montana, on Tuesday, September 23, 2014. The accident happened on Highway 93, late in the afternoon.

Reports say that Dullinger was traveling north along Highway 93 when the trailer pulled out on the road ahead of him. Dullinger wasn’t able to stop and crashed into it. The collision pushed him into the guardrail.

There’s been no word on the truck driver. Police are investigating the accident.

I think a lot of people’s first response after seeing an accident like this would be that the truck driver was definitely in the wrong. He shouldn’t have pulled out into the road that close to an oncoming car. Case closed. In a perfect world, that would be it. However, a perfect world this is not, and I can tell you that following an accident, a trucking company is going to have a prepackaged defense for every eventuality that they’ll be able to trot out and use to defend their case. I’ve litigated several accidents similar to this one in the past, and every time a commercial truck is hit from behind they say the same thing: Their driver thought he had plenty of time to make the turn, but the other driver was speeding and rear-ended them. Every time. So it’s important to keep in mind that while, at the outside, an accident may seem very black and white, it often doesn’t take long for it to get muddled.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
