Thomas Hubbard Injured in 18-Wheeler Accident on M-115 in Cadillac, Michigan


Cadillac, MI — Thomas Hubbard was one of three men injured in an accident with an 18-wheeler in Cadillac, Michigan, on Tuesday, July 15, 2014. The accident took place on M-115, between 13th Street and Boon Road.

According to reports, an 18-wheeler was exiting a private driveway and came into the path of a pickup truck being driven by Hubbard. Hubbard, along with Scott Peterson sustained only minor injuries and have already been released from the hospital. Howard Clark was critically injured and taken to Munson Medical Center.

A fourth man, Joe Hershberger, was also in the pickup and killed in the accident.

The driver of the 18-wheeler, Steven Landre, was not injured. Police are currently investigating the accident.

Commentary

Unfortunately, this may be a situation in which the police report doesn’t do a whole lot of good. Police reports are more concerned with telling the reader what happened, as opposed to who’s liable for an accident. And it’s important to remember that those two things aren’t always the same thing. Take this accident for example. The pickup truck crashed into the 18-wheeler. Based on that information you might the pickup truck is at fault, but that’s not necessarily the case. Let’s ask some questions. How far away was the pickup when the 18-wheeler came out into the street? Did the driver have enough time to brake, or did the 18-wheeler just pull out in front of him? Already, we’re dealing with information that wouldn’t necessarily be in a police report. In these cases, having a private investigation conducted is always advisable. I’ve run several in my time as an attorney, and I’m constantly surprised by the things I find that, for one reason or another, don’t make it into police reports.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
