UPDATE: Paula Flores Injured in Suspected Drunk Driving Accident in Woods Cross, Utah


WOODS CROSS, UT — A single-vehicle rollover accident left two people in the hospital in Woods Cross, Utah on Monday, July 7th, 2014, according to the news report from The Davis Clipper.

Police have said that they have reason to believe Paula Flores was hurt when the vehicle she was in is believed to have lost control for reasons currently under investigation while driving on the 500 South Frontage Road around 12:30 in the morning Monday.

Both 22-year-old Paula Flores and 21-year-old Tyler Cotter were taken by EMS personnel to Intermountain Medical Center with unspecified injuries.

Authorities have said that they think alcohol and speed may have played a role in the accident, but have not yet released the results of their investigation at the time of writing.

Utah State Police are currently investigating the accident.

Commentary:

There could be a few avenues this accident takes. Depending on the liquor liability laws, there could be a claim against a bar if the driver of the offending vehicle recently left one after being over-served. On the off chance there is no dram shop claim available, there could be a negligence claim against the driver of the vehicle if they are found to have been intoxicated and speeding. Again, the facts rest on a number of variables, but this accident would surely be worth a much closer look than this news article provides.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
