Dennis Yoder, Mariann Yoder Injured in DUI Accident in LaGrange County, Indiana

LaGrange County, IN — At least two people were injured in an accident between a car and a hay truck in LaGrange County, Indiana, on Monday, June 9, 2014. The accident took place on County Road 250 North at 1150 West.

Dennis Yoder and a passenger were riding in a hay truck when they were hit from behind by a car being driven by Stephen Blough. Reports indicate that the hay truck did not have brake lights, and was using only a small white light on the back of the truck.

Police found the Blough was intoxicated at the time of the accident.

Dennis and Mariann Yoder were both taken to Elkhart General Hospital for minor injuries. Police cited Yoder for not having taillights and filed charges against Blough for DUI and driving too fast to avoid a collision.

It’s clear from what’s been reported that both of the drivers share some of the blame here. One of them was driving without taillights, and the other had been drinking. The task before us now is to determine comparative responsibility by figuring out exactly how much each party contributed to the accident. Indiana follows what is called the “51 percent bar rule,” which means that an injured party cannot recover damages if it’s found to be more than 51% responsible for an accident. What will need to be determined is which party was more than 51% responsible for this accident.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
