Commentary:
This is one of those accidents that may look like it has an open-and-shut fact pattern, when in reality, there is always a fight when we’re talking about a commercial freight company. These companies have dealt with accidents just like this one for decades on end, while their victims have only had experience with maybe one or two fender-benders in their lives. These companies are also fully aware they have far greater resources to use in a fight, because these companies know what they are doing. Leveling the playing field with equal experience can go a long, long way in dealing with these situations.
