UPDATE: Luis Guzman Injured in Suspected Alcohol Related Accident in Battle Ground, Washington


BATTLE GROUND, WA — One person was seriously hurt in a crash in Battle Ground, Washington on Tuesday, May 6th, 2014, according to a news article from Fox12 Oregon.

Authorities have said that they believe Luis Guzman was hurt when the vehicle he was driving drifted off the road and crashed while driving on Interstate 5 Tuesday night. It is not clear what may have caused the crash.

Luis Guzman was taken by EMS personnel to a nearby hospital after the crash for the treatment of unspecified injuries.

Police believe alcohol may be a factor in the crash.

Commentary:

Many states have liquor liability laws, but the majority of them are not equipped with first party protections. What does this mean? A first party claim against a bar would involve a customer being over-served alcohol at a bar, before leaving and hurting or killing themselves in an accident, the bar could be liable for their damages. This is no different then a surgeon allowing a patient to leave under the influence of anesthesia, the doctor could be liable for any accident their patient causes. This is not different than a server at a bar, who has an obligation to cut off intoxicated patrons.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
