ANDERSON COUNTY, TX — Two people were killed in a major accident that happened in Anderson County, Kentucky on Friday, March 21st, 2014, according to the report from Lex18.
Police have said that they have reason to believe Jacob Blankenship was killed when the car he was in crashed into a tractor-trailer that was parked along the side of the road on Bluegrass Parkway.
Scene of the Accident
Jacob Blankenship was killed in the accident, as was Qua Weaver. It is not clear if they were killed instantly in the accident or if they were taken by EMS personnel to a nearby hospital where they succumbed a short time later.
The investigation into the accident is being spearheaded by officials from the Kentucky State Police.
I’ve seen and handled a case very similar to this one where a vehicle collided with the rear of a parked tractor-trailer, and many of the people who see this fact pattern would be quick to blame the people in the car, but there are a few facts we don’t have that could drastically sway liability in the other direction. For instance, if the truck was parked in the emergency lane, was there a real emergency? Or did the driver just stop for some quick shut eye? Furthermore, was the truck pulled all the way out of the lanes of traffic? Was there clear signage to warn other drivers that is mandated by the Federal Motor Carriers Safety Act?
There are plenty of factors that we have not seen in this news article, but jumping to conclusions should be the last thing people should do in an accident of this nature.
