One Injured by Suspected Drunk Driver Joseph Munoz in Livermore, California


According to local reports a 41-year-old man was struck by an alleged drunk driver in Livermore California. The accident occurred around 11 p.m. Tuesday August 23 when 34-year-old Joseph Munoz apparently ran a red light and struck the mans Camry. Police state Munoz then fled the scene on foot but was later found and arrested. The unidentified victim was taken to Eden Trauma Center with what are thought to be non-life threatening injuries.

Commentary
I just recently wrote about the nature of hit-and-run accidents and how there is almost always more to the story than is presented in the news. Sometimes those that flee are hiding possession or maybe warrants or often like in this case alleged drinking. These types of incidents require a specialized independent investigation to determine liability as there very well may be more than one party at fault. For example in many states if the driver who is at fault in an accident was found to be imbibing at a bar or residence that bar or homeowner could be held partially liable. Unfortunately the state of California holds neither dram shop laws (laws many states use to hold alcohol-serving establishments liable) or Social Host laws (laws that hold a homeowner partially accountable for their guests) that could identify and hold accountable a third party.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
