Welder Injured in Tank Explosion Accident in Collin County, TX

Shortly after 5 p.m. on Wednesday October 6 a welder in Collin County TX suffered injuries caused by an explosion from an acetylene gas tank. The victim was taken by air to Parkland Memorial Hospitals burn unit in Dallas TX. the victims name and condition have yet to be released.

On-the-job injuries can occur in a wide variety of ways and explosions lie on the more devastating end of the spectrum as far as the severity of on-the-job injuries. It would appear that this particular worker sustained severe injuries especially considering that the worker was taken to the burn unit of an area hospital. The worker may likely be in need of compensation in order to help with the medical expenses now incurred as a result of this accident. Since the details to this particular story are currently scant presupposing what occurred prior to a full investigation can prove to be a worthless endeavor. However an experienced investigative team will likely be sure to look and see if the welders employer could have held any liability in this case such as not providing adequate help for this worker or not ensuring that proper safety measures are both known and utilized. If this is the case and theres no way to tell if it is or not without a proper investigation then the employee may be able to bring a personal injury claim against his employer to seek compensation for any sustained injuries.

However since this accident occurred in Texas the employer will then have to deal with the issue of whether or not the employer is covered by workers compensation insurance. If the employer is covered by workers comp a personal injury claim cannot be brought against the employer and the employee must seek compensation through the workers compensation insurance agency. However if the employer is not covered by workers compensation insurance then the employee can bring a personal injury claim against their employer. In either instance its likely in the best interests of the injured worker to speak with their familys legal counsel in order to have a full understanding of what their possible legal options are for recouping costs associated with the injury sustained.

Dallas Police Officer Struck by Drunken Driver in North Dallas, TX

Around 1:15 a.m. on Thursday October 7 a Dallas police office was struck by a suspected drunken driver at the intersection of Beltline Road and Monfort Drive in North Dallas. The police officers car then crashed into two more cars also at the intersection. The police officer was consequently rushed to the hospital. Investigators say that Melinda Barbara Rodriguez the 29-year-old driver of the car that crashed into the officers vehicle was not able to pass a field sobriety test and was consequently arrested. According to police reports Rodriguez failed to stop at a red light on Beltline Road which then caused the collision with the police officers car as he was heading south on Montfort Drive. Rodriguez is currently in jail. The other drivers involved in the accident were not injured and the police office is expected to recover.

From the news report of this accident it would appear that the police office is going to recover from his sustained injury. Unfortunately many victims of a drunk driving accident are seldom as lucky if luck can even be used as a term when talking about drunk driving cases. As you can well imagine drunk drivers have the possibility of causing immense amounts of damage with their negligence and as such they should be held responsible for any injuries they might have caused.

Furthermore Texas has laws that can be used to hold alcohol-serving establishments additionally liable for drunk driving accidents that their patrons may have caused. Known as dram shop law these laws have been put into place so that the responsibility for public safety is shared by any establishment that chooses to serve alcohol to their patrons. If these bars or restaurants knowingly allow an intoxicated driver to leave their premises or continue to serve alcohol to a patron that causes that person to exceed the legal blood alcohol content level of .08% then that alcohol-serving establishment can be held liable for whatever misfortune the patron may cause after leaving their establishment.

Proving such a chain of events can sometimes be challenging but its important to do so in order that all liable parties are held accountable both so that the injured victim can receive compensation for their injuries and so that future incidents have a much less likely possibility of happening. This can often only be done properly by an experienced attorney so its recommended that a victim such as the police officer in the news article above contact his lawyer in order to seek all liable parties for his accident so that justice can prevail.

Mansfield, TX Worker Shocked in Industrial Incident

A Mansfield Texas worker suffered an electrical shock at an industrial building in southwest Mansfield where he was working on the morning of Thursday October 7. The unidentified man was rescued from the rooftop of the industrial building and then flown to a Fort Worth hospital to be treated for his sustained injury at 11 a.m. The cause of the electrical shock incident has yet to be determined.

In accidents such at the one above a full investigation must be made into the accident site to ensure that all liable parties are brought to justice. While it appears that the workers injury is not life-threatening it would also appear that this worker has accrued medical bills and a personal injury claim against a negligent party or parties could help him recover the costs associated with those medical bills. Furthermore employers can be held liable for unsafe working environments that may lead to certain accidents such as what could have occurred in this particular situation. In that event the injured worker could also bring a personal injury claim against his employer.

However even then it can sometimes prove challenging to seek compensation against an employer based on a couple of factors: whether the employer is covered by workers compensation insurance and whether the employee is defined as a contractor or an employee. In the first instance in Texas employers covered by workers compensation are immune to personal injury claims meaning that they cannot be sued for compensation by the injured worker. The worker would then have to seek compensation through the employers workers compensation insurance company. However some employers may lie about their coverage knowing that they could escape liability for an accident by simply claiming to have workers compensation coverage when in fact they do not. Quite often only the help of a legal professional will be able to ascertain whether or not an employer is telling the truth about their coverage.

Additionally an employer may claim that an injured worker was not an actual employee but a contractor. If the worker can be made out to be a contractor then he or she would be wholly responsible for their safety while on the job thus causing the employer to have little to no liability in the accident case. However if the worker can be proven to be an employee then the employer will share a portion if not all of the liability for the accident.

Personal injury accidents that occur while on the job can sometimes seem simple at the outset but often involve many more technical matters as further information from the accident is made known. In any accident case its recommended that the victim or the victims family contacts their family lawyer so that they can receive proper legal help towards getting them the compensation for their sustained injury that they likely deserve.
