Denison, TX: Sonic Employee Injured by Alleged Drunk Driver

Denison, TX — The police in Denison have identified the driver who was arrested after last weekend’s accident at the Sonic on Austin Street. They said that Ernest Burns, age unknown, crashed his car into the side of a Sonic restaurant last Sunday morning (November 22, 2015) and injured an employee inside.

This happened at about 10:30 a.m. that Sunday morning, at the location on Austin Street. Burns was apparently trying to pull into the popular drive-thru restaurant when his car failed to stop and it crashed through the drive-up kiosk and into the side of the building (pictured). An employee inside was burned by some of the equipment, which was moved around by the force of the impact. That person was taken to the hospital and was treated, but was not believed to be in serious condition.

Right now, the cause of the accident is believed to be alcohol-related, as Denison PD arrested Burns and charged him with intoxicated assault, driving while intoxicated, and some other offenses.

Commentary:

Since alcohol is a factor here, I think it’s important that I share the article below. In it, I talk at length about alcohol-related accidents (both in Texas and in other states) and how the law handles them. Essentially, everyone likes to point the blame at the accused driver who crashed their car, but the truth of the matter is that there’s often another guilty party: bars and other licensed providers of alcohol.

Our society tends to focus on the drivers who make the mistake of getting behind the wheel while intoxicated, but in fact, a lot of bars break the rules when they serve someone so much alcohol that they become intoxicated. In fact, depending on how much alcohol they serve, it can be decided by a jury that the bar actually contributed to the accident that happened when their customer got in his car and crashed, hurting innocent people.

Regarding this accident, it’s just fortunate that nobody was more seriously hurt. There are few things more dangerous than a car with a driver who’s not in control.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
