Boerne, TX: Worker Hospitalized at Construction Site when Graders Collide


Boerne, TX — Two graders at a construction site in Boerne collided in a major accident this past Thursday afternoon, October 8, 2015. Police said that one of the workers was pinned inside the cab of the grader and had to be cut out, whereupon he was immediately taken to a hospital for his injuries.

This happened before 6:00 pm. on Thursday, at a construction site off I-10 and Dietz Elkhorn Road.

Though the details surrounding this accident are a little unclear at this point, it appears that the two graders were moving toward each other and accidentally collided, trapping one of the drivers inside the cab.

At the last update, the worker had been flown to University Hospital, but his name and condition haven’t been released yet.

Commentary:

One of the things I’d like to point out about accidents at large construction sites is that it’s highly likely that multiple companies, contractors, and sub-contractors are going to be working next to each other. If an accident happens on the job and it’s caused by a worker from a different company, the injured worker may have a claim against that company for their employee’s negligent behavior.

Legally speaking, this is an interesting concept because, under normal circumstances, Texas law allows zero lawsuits to be filed in work-related accidents if the employer subscribes to workers’ compensation coverage. I won’t get into all the details of why those laws exist (or why they’re unfair and give workers the short end of the stick), but suffice it to say that it’s very restrictive for injured workers and their families…while being very profitable and protective for employers. But like I said, if the accident happens between two unrelated companies, then it’s a different ballgame altogether.

I’d be interested in seeing more of this investigation as it unfolds, because two graders colliding at a worksite is quite an accident and it’s a miracle that nobody was killed.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
