Cape May, NJ — There was an accident reported in mid-July that left a family of four in an SUV with injuries while another driver was charged with driving while intoxicated. This happened on Saturday, July 18, 2015 and driver who was arrested was later ID’d as Thomas Fox, from Pennsylvania.
The police said that Fox had been driving his car south along Seashore Road on Saturday when he came upon a section of the road that curve to the left, near Carl T. Mitnick School.
As he tried to negotiate the curve, Fox’s car swerved into oncoming traffic and hit a northbound SUV carrying a family of four.
The folks inside the SUV were injured and taken to a hospital while Fox was found to be intoxicated by the responding police officers from the Lower Township Police Department. The police have since charged Fox with assault by auto, various traffic-related offenses, and driving while intoxicated in a school zone.

Commentary:
In New Jersey, those who drink and drive are subject to some stiff penalties, but so are bars and other establishments that serve “visibly intoxicated person” (N.J. Rev. Stat. §2A:22A-4). The law says that not only is it illegal to drink and drive, but it’s also unlawful for bars to serve alcohol to folks who shouldn’t be drinking anymore. If this driver was really under the influence when the wreck happened then the police did the right thing by arresting him, but if he had come from a bar that over-served him, then there may need to be some more investigating here.
