Police enjoy certain protections whenever it comes to accidents like this one. In Texas, however, lawmakers passed the Texas Tort Claims Act, which allows government entities to be held responsible for what’s known as “tortious conduct.” Police can be protected from liability if an injury happens as a result of them carrying out their duties as police officers. This is known as the emergency exception. However, police can still be held liable if an accident takes place in a non-emergency situation. The same applies to other workers, as well, such as ambulance drivers. Of course, the Texas Tort Claims Act won’t apply outside of Texas, so those involved in these sorts of accidents will need to check to see exactly what the laws in their state say.
