I think it’s safe to assume that both of the drivers involved in this accident were on the job when it happened. Whenever these sorts of accidents happen, an employer will usually have a workers’ comp policy that will step in and provide coverage for things like medical treatment, etc. Workers’ comp laws will forbid an employee from filing a claim against their employer. However, these laws won’t apply when the accident is found to have been caused by a third party. So, let’s look at whoever isn’t at fault in this accident. They’re going to be eligible for workers’ comp benefits, but they’ll likely also have a claim against the other driver for causing the accident. Hopefully the investigation into the accident will be able to shed a little more light on what happened here soon.
