Pedestrian Accident Leaves Elderly Woman Injured in Houston, TX on Cavalcade Street


Houston, TX — Police reported an SUV-pedestrian accident this past Friday in the northern part of Houston, just off the I-45 North Freeway. They said that an elderly woman in her 70’s was injured after being hit by an SUV while trying to cross Cavalcade Street on foot.

The accident took place at about 9:45 a.m. on Friday morning, July 3, 2015. Police said that the woman was crossing Cavalcade Street on foot that morning and was headed for the METRORail nearby when she was accidentally hit by a passing SUV.

The driver of the SUV may face charges later, the police said, and the elderly woman is recovering in a hospital.

Commentary:

Why would a driver face charges for hitting someone who ran out into traffic? That’s an interesting question, and it’s one we get a lot at our firm. It’s also not without it’s assumptions, wouldn’t you agree? The question assumes that the pedestrian was in the wrong and it assumes that the driver who hit them was following the rules of the road to the letter.

While there are certainly instances where it happens, not many accidents are the result of any 1 person’s fault, but the combined fault of those involved. For example, what if this woman was crossing the street outside of a crosswalk, but the driver of the SUV had been intoxicated? Looking at their phone? Speeding?

I don’t know what the police mean when they said “the driver might be cited,” but there must be more here than what we’re seeing.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
