Commentary:
The first thing that needs to be established is why the truck left the road in the first place. Was there possibly another vehicle involved? Did something go wrong within the braking, steering, or mechanics of the truck? If another vehicle was acting erratcially, and the driver had to swerve, there doesn’t necessarily have to be vehicle-on-vehicle contact to be considered a hit-and-run. Simply put, you don’t have to hit another car to cause an accident. On the other hand, if there was a problem with the truck that took this accident from bad to worse, then the manufacturer of the truck could be liable for some part of the accident. Looking further into this may tell us a lot more about what happened, and who may be responsible, but nobody will know until somebody breaks out a toolbox.
