Working with heavy machinery like bulldozers or front end loaders can be extremely dangerous.  Construction workers receive many injuries from heavy machinery every year.  If you have been injured by heavy machinery, you are probably seeking financial compensation from your employer.  This can be more difficult than it sounds.

This difficulty largely results from the complex interaction of various laws and regulations in place concerning the conditions upon which an employee can bring a personal injury suit to his or her employer.

Many construction companies are aware of this legal complexity and seek to exploit it in order to save money.  For instance, they may seek to avoid paying for workers' compensation insurance.  Workers' compensation is designed to protect employers from personal injury lawsuits by providing financial coverage for injuries sustained by employees.  Employees receive compensation for their injuries (with some restrictions and limits on how much an employee can receive) and the employer avoids lawsuits.

Companies that do not have workers' compensation insurance (or non-subscribers) are vulnerable to lawsuits in personal injury cases.  Unfortunately, these laws usually only apply directly to employees, not contractors.  This means that a contractor may run into legal difficulties if he or she attempts to bring a personal injury suit to his or her employer.

Less scrupulous construction companies will hire primarily contractors and then not subscribe to workers' compensation insurance.  They think this makes them immune to personal injury suits and saves them the cost of workers' compensation insurance.
