Couple & Dog Injured in Waco, TX after Pit Bull Attack


Waco, TX — A husband and wife were walking their dog in a residential area of Waco this past Sunday when they were apparently attached by a pit bull. This happened on Sunday morning, May 3, in the Rambler Drive & Hilltop Drive area, police said.

The wife, Loren Schwartz, told police that she and her husband were walking their dog when the pit bull appeared from a yard and attacked them.

The pit bull badly injured the Schwartz’ dog, dislocated one of Loren Schwartz’ fingers and left her husband with a fracture and scrapes. The owner of the dog was contacted by police, but they didn’t have any up to date records of vaccinations. Allegedly, if the owner pays some fines, the pit bull will be released.

In Texas, we have something commonly referred to as a “One-Bite Rule.” Essentially, it means that people who have dangerous animals are required to restrain them — provided they have a history of violence or attacks. If not, then there’s a “one-bite” policy that Texas law allows as a measure of grace. That is, the first bite’s free for the owner of the animal (in terms of liability) unless the victim can prove the animal had a history of violent behavior or attacks. I don’t really know all the details of this dog bite incident, but this is a common question we get at the firm.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
