Oftentimes in drunk driving accidents, the drunk driver has recently been at a bar or restaurant where he or she was drinking excessive amounts of alcohol. If a bar or other establishment serves alcohol to an already-intoxicated person and that person then has an accident which injures someone else, the establishment that served the alcohol could be liable for part of the damages under the Texas Dram Shop Act.
The Dram Shop Act states that an establishment is partly liable for damages caused by its intoxicated patrons under certain conditions. It must have been evident to the alcohol provider that the patron was already intoxicated to the point of being a danger to himself or others. Furthermore, it must have been determined that the auto accident was the direct result of the patron's intoxication.
Under the safe harbor defense, however, an establishment may be able to avoid liability. If the employer at the establishment has required all employees to attend a training program, all employees actually did attend that training program, and the employer did not encourage employees to violate the Texas Dram Shop Act, then the establishment is likely not liable.
