Anytime I see a drunk-driving accident, I have to wonder where the driver got the alcohol from. In an accident like this, the driver could have gotten liquor from anywhere. But the time of day at which the accident happened makes it likely that the driver was at a bar at some point in the night. This is important because, in Texas, establishments that serve alcohol are barred from serving those who are obviously intoxicated.

Texas isn’t the only state with laws like this. They’re designed to cut down on the number of alcohol-related accidents, because, as it turns out, the more alcohol someone consumes, the more likely they are to get into an accident. If a bar over-serves someone who should have been cut off, and that person goes out and gets into an accident, then the bar can be held liable for it. Again, these laws are designed to stop drunk-driving accidents from happening, and bars that choose to ignore that are actively working against them. They should be held responsible for that, rather than being allowed to open their doors the very next day as if nothing’s happened.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
