Henry Schwass Injured in Semi-Truck Accident on Highway 16 in Star, ID


Star, ID — A man was hospitalized following an accident between a semi-truck and a box truck in Star, Idaho, on Tuesday, March 31, 2015. The accident happened at the interstate of highways 44 and 16, around 9:45 in the morning.

Local reports said that Henry Schwass, who was driving a box truck north on Highway 16 and failed to stop at a stop sign. His truck was hit by a semi being driven by 55-year-old Bruce Koonce.

One of the trucks was carrying a load of nails, which spilled onto the road and had to be cleared away.

Police have cited Schwass for careless driving. He was taken to a local hospital for his injuries.

Accidents like this are a little tricky, as they’re considered work accidents, yet involve a third party who’s ultimately responsible for what went wrong. In accidents like this, the injured worker is typically eligible for workers’ comp benefits. However, while workers’ comp wouldn’t allow him to file a claim against his employer, that protection isn’t extended to third parties. This means that the injured worker could bring a claim against the third party — provided they’re responsible for the accident — while still receiving benefits from WC, as the accident still happened while the victim was on the job.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
