Several details have been left out of the stories reporting on this accident. Was the police officer trying to movie through a red light at the time? How fast was he traveling? How fast was the 18-wheeler traveling? Until those questions are answered, determining liability would be tough.
I can say, however, that if this accident turns out to be the fault of the 18-wheeler, the police officer would likely have a claim against the company while still being eligible for workers’ comp benefits. One drawback to workers’ comp is that it prevents employees from filing claims against their employers. However, if a third party is involved in the accident, and responsible for any injuries caused, then a victim has every right in the world to file a claim against them. They still remain eligible for WC benefits, however, as the accident happened on the job.
