Commentary:
A lot of the fault in this accident is going to depend on a few bits of information that cannot be found in any of the news reports I’ve seen. The first thing that needs to be determined is if the fire truck was en-route to an emergency. If the fire truck was responding to an emergency with the lights and sirens activated, then the driver of the pickup truck is probably going to bear the most of the fault. Any emergency response vehicle typically has the rule of the road in the event of a crisis, and accidents that happen when vehicles fail to yield to them is usually on the car driver’s shoulders. If this turns out to be the case here, then the firefighters could file a claim against the driver of the pickup truck in the accident, in addition to seeking a workers’ compensation claim from the department. The firefighters are not strictly relegated to one path or the other, in reality, they have the option to pursue both options concurrently, which usually benefits victims far more than just sticking with one avenue for recouping what they lost in the accident. Again, it depends on a lot of information that we don’t currently have, so if anybody knows the slightest detail more than what was reported in the news, I’d be all ears.
