The Statute of Limitations in a Texas Personal Injury Case
The statute of limitations is the time frame in which a plaintiff has to pursue legal action against a defendant. In the state of Texas, this time frame is relatively short. The length of the statute of limitations is primarily dependent on the type of case involved. Typically, however, the statute of limitations is two years from the date of the incident. For the following cases, the statute of limitations applies accordingly:
• General personal injury: two years from date of incident • Car accident: two years from date of incident • Work accident without workers' compensation: two years from date of injury • Wrongful death: two years from date of death • Product liability cases: two years
However, there are certain situations where an exception may occur. The sooner you hire an attorney, or at least consult with an attorney to get a professional opinion, the better the chance that your case will be successful. The closer to the end of the statute of limitations that you contact an attorney, the greater the chance that the attorney will not be able to help you. In any event, it is always worth getting a free consultation from an attorney, even if you think the statute has expired, just to be on the safe side.
