Commentary
One of the first lessons we learn as children is that we have to look both ways before crossing the street. This is because we’re expected to oncoming traffic. If a truck or motorcycle or man on a horse needs to back up on onto a street for whatever, that’s okay, but they have to make sure that no one’s coming so that they can avoid accidents just like this.
Unfortunately, even in a case like this, where fault is pretty clearly established, motorcyclists still face many challenges. The reason for that is many have a bias against motorcycles. After an accident like this, a driver that simply say that the rider was speeding, and people will believe it. Proving a case like this requires evidence, and that means a complete and thorough investigation of the scene of the accident. Unfortunately, your typical police investigation doesn’t do the job, as it’s more concerned with figuring out how an accident happened. If a law was broken, they’ll cite someone and move on. An independent investigation will tell a victim how the accident happened, but also why. And that’s information can prove invaluable down the road.
