Commentary:

This is a sensitive subject, so I want to be very clear in my intentions here. Our firm gets all kinds of question about lots of different topics, but some of them involve accidents that happen at people’s homes. In those cases, people often want to know what kind of options there are for filing claims, since it’s clearly different from, say, a car accident. The truth of the matter is that instead of a car insurance policy, your home usually has a “homeowner’s insurance” policy that covers any kind of accident on the property. It also protects the homeowners assets and real estate, so that any claim filed will be paid out of the insurance money, not through the selling of the property.

I don’t know how this particular accident happened, who the zip-line belong to, and whether this was an official Boy Scouts trip that was being supervised. However, if the accident happened on the property of a resident and it’s determined that some negligence contributed to the accident (such as the line not being secured or something of that nature), then the person filing a claim would do so against the homeowner’s policy. Again, I’m not saying that a claim needs to be filed or that there’s even a possibility for one, but that’s how these things are usually handled, from a legal perspective.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
