TALLHASSEE, FL — Kimberly Palmer was killed in a serious accident with a tractor-trailer that happened in Tallahassee, Florida on Monday, January 26th, 2015. The news article said that the accident happened sometime early Monday morning.
Kimberly Palmer was killed when the car she was a passenger in was hit by a tractor-trailer while driving on Interstate 10. Officials said that the tractor-trailer lost control before driving into the lanes of oncoming traffic where it collided with the Palmer’s vehicle.
Palmer was taken to a nearby hospital where she died a short time after her arrival. The driver of the car was identified as Duane Palmer, who was hurt in the accident.
Florida State Police are currently investigating the accident.

The news said that the tractor-trailer “lost control”, and many may think this is some kind of unavoidable event. I disagree wholeheartedly. I’ve been litigating and handling commercial vehicle and tractor-trailer accidents for 25 years, and I’ve yet to see a single one “lose control” that was driving at a speed that was safe for conditions, be it weather, traffic, or the grade of curve or incline in the road. It simply doesn’t happen. If a dog walker “loses control” of a vicious dog by dropping it’s leash, does that make them any less responsible for what happens? I don’t see any difference between this, and a truck driver who lets their speed or vehicle get the better of them. This is ultimately a trained driver, and if they ignored their training and lost control of a massive tractor-trailer, then the company that trusted him with a truck needs to answer for the accident.
