Commentary
Police cited the driver responsible for this accident, but many don’t know that a ticket doesn’t constitute a legal obligation for someone who’s caused an accident to make things right with those he’s hurt. Beyond that, insurance companies have a legal obligation to defend their clients. So anyone involved in an accident like this shouldn’t assume that filing an insurance claim will be the end of their troubles. They can often be just the beginning. An insurance company is only going to pay someone once they realize that dragging an accident in front of a jury is going to cost them more.
