Commentary:
If what the news reports suggest about this accident turns out to be true, and the driver of the crane truck did in fact run the red light, then the company behind the crane truck is probably going to be scrambling for a defense strategy or damage control of some kind. If you’re surprised that a company would defend a red light runner, you’d be stunned at the behaviors I’ve seen tried to be justified by these companies. Ultimately, no matter how valid the claim against them may be, they’re more than likely going to put up stiff resistance, in all of the 25 years I’ve been litigating truck accidents, I’ve yet to see a trucking company not fight a claim. However, no matter how hard they try to defend this driver, any good lawyer knows how to poke holes in their argument with “negligence per-se”, which means an action is negligent because it violates a law or statute, in this case, ignoring a red light.
