Commentary:

Whenever I see a accident fact pattern where cargo has fallen off a moving tractor-trailer, I cannot begin to stress just how much has to go wrong for such an event to take place. To begin with, there could be liability on the company that was responsible for loading and securing these tanks onto the truck. Sometimes freight moving trucks simply back into a company’s dry dock where the company loads the trucks, and sends them on their way. If the company that put these tanks on this truck failed to do so securely enough, then they need to answer for their handiwork and take responsibility for the accident.

On the other hand, if the driver of the tractor-trailer failed to make sure his cargo was tied down and secure, as he is obligated to do before he leaves for a haul, then the trucking company needs to answer for the role they played in the accident. Many people would call this a freak, unavoidable accident, but I honestly believe that there is no such thing. I few more ties, a few more minutes of work done properly could have prevented this whole thing from happening.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
