Liability in this accident doesn’t seem like it would be too hard to establish. If the semi rolled over because something was wrong with it, then that might shift liability onto the manufacturer. But if it rolled because the driver was taking a curve too fast, then that’s on him. I can say that even being found liable by police following an accident does not constitute a legal obligation to make things right with an injured party. Pursuing those claims to completion is the job of the victims. And victims need to remember that an insurance carrier’s best interests are not necessarily their own best interests.

The settlement process is often long, tedious, and confusing, which works out in the insurance carrier’s favor. They want it to be as difficult as possible, because that increases their chances of shortchanging or outright denying a victim’s claim. It’s important for victims to educate themselves on every step of the process following an accident, because an insurance carriers have no problem taking advantage of those in unfamiliar waters.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
