Troy Township, WI — A woman was sent to the hospital following a semi-truck accident in Troy, Wisconsin, on Thursday, December 18, 2014. The accident took place on Highway 20, around 8:00 in the morning.
Police identified Kenneth Ferry as the driver of the semi belonging to Lowell C. Hagen Trucking who lost control of the vehicle while going around a curve and turning over. The semi turned over on top of a Volkswagon Passat that was being driven by 56-year old Kimberly South.
The collision sent South’s car off the road, where it rolled over in a ditch.
South, as well as Ferry were taken to nearby hospitals. Their injuries have been described as non-life-threatening.

Liability in this accident doesn’t seem like it would be too hard to establish. If the semi rolled over because something was wrong with it, then that might shift liability onto the manufacturer. But if it rolled because the driver was taking a curve too fast, then that’s on him. I can say that even being found liable by police following an accident does not constitute a legal obligation to make things right with an injured party. Pursuing those claims to completion is the job of the victims. And victims need to remember that an insurance carrier’s best interests are not necessarily their own best interests.
