Commentary
Many people I’ve encountered during my time practicing law have had a lot of misconceptions about accidents like these and how they affect passengers. Many believe that a passenger is protected under their own insurance, others believe they have no protection at all. Neither is true. Passengers are typically covered under a driver’s insurance, which in effect makes the driver responsible for his passengers.
There are instances in which liability for an accident would be placed on a third party. If an accident were the result of a mechanical defect in the car, or perhaps shoddy automotive work, then the auto manufacturer or a garage could be held partially liable.
