Commentary
People I’ve come across in my time practicing law are typically very confused about how single-vehicle accidents are handled. Many believe passengers are covered by their own insurance policies, or aren’t covered at all. Neither is correct. A passenger inside a vehicle is covered by the driver’s insurance, which in effect makes the driver liable for his passengers. There are of course extenuating circumstances which would push liability off the driver. If an accident was caused because of a mechanical defect, for example, that would be an issue of manufacturer liability. Auto garages can also be held liable, if the accident occurred as a result of shoddy work they had done.
