Austin, TX — A man has been sent to the hospital in critical condition after being hit by a dump truck in Austin, Texas. The accident took place on Friday, November 14, 2014, around 2:00 in the afternoon.

Unfortunately, there are still several questions news reports don’t have answers to at this time. The question we need to be asking right now is, did the driver of the dump truck have the chance to avoid this accident, and if so, why didn’t he? Accidents like this are often caused through driver inattention. Other times, they’re caused because a pedestrian will be walking in the road. Still, even in those situations, a driver doesn’t have carte blanche to hit anyone who gets in his way. If they have the opportunity to avoid the accident, they have to take it. If police find that the driver could have avoided the crash, or for some reason wasn’t paying attention to the road, he’s going to be liable for the accident, and the victim is going to be free to file a claim against him.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
