ORANGE COUNTY, TX — Paula Simm and three passengers were seriously injured after a major accident that happened in Orange County, Texas on Wednesday, November 12th, 2014. 12 News Now said that the accident happened around 9:00 Tuesday morning.
57-year-old Paula Simm and her three passengers were hurt when the Audi they were in and a tractor-trailer collided on Interstate 10. Police said that the truck skidded out of control before hitting a concrete barrier. When the truck hit the barrier, the trailer separated and tipped over into the path of the Audi in the westbound lanes.
Simm, and her three passengers were rushed to Christus Hospital St. Elizabeth with unspecified injuries.
The driver of the tractor-trailer was identified as 58-year-old Jerry Perry, who was cited for failure to drive in a single lane after the accident.
The investigation is currently ongoing.

Just from the few facts we have about this accident, the trucking company is probably already deep into the process of formulating a defense strategy. The news mentioned an unconfirmed report that the truck suffered a tire blowout in the moments before the crash. If true, this still does not bode well for the trucking company and they know this. To add even more gas on the fire, the trucker was cited for failure to stay in a single lane after the accident. Now, you may think that with this fact pattern, that the trucking company is going to throw up it’s hands and make everything better, right? Wrong. I’ve simply never seen it happen. Trucking companies will always defend their driver in order for the accident to effect their bottom line the least. I’ve seen several people assume that they can take on these trucking companies and the nearly unlimited legal resources they wield. Don’t assume you’ve got the upper hand just because the trucking company is obviously at fault, you’ve still got quite the fight ahead of you.
