BRYAN, TX — One person was hurt in an accident involving a tractor-trailer in Byran, Texas on Sunday, October 26th, 2014. The article from KBTX said that the accident happened sometime Sunday afternoon.
One person was taken to the hospital after an SUV and a tanker-truck tractor-trailer collided on FM 158. Authorities believe the tractor-trailer attempted a U-turn when the truck hit the SUV.
The driver of the SUV had to be pulled from the wreckage by first responders. She was taken by EMS to a nearby hospital for unspecified injuries.
The driver of the tractor-trailer was cited for the accident after the crash.

The news said that the truck driver was cited for the accident, although it doesn’t say what for, but many people in this situation may think that the citation is going to be the end-all-be-all smoking gun evidence in a case like this, and while it by no means hurts to have a truck driver cited after a crash, it isn’t exactly a ticket to an easy case. In reality, the truck driver can fight the citation in court just like any other moving violation. Additionally, the trucking company will mount a defense even when they know their driver caused the accident as a matter of business. Simply put, they’re out to shield their bottom line from any damage, even if it is self-inflicted. With this particular situation, they may say that the victim’s car was speeding, or they could have avoided the accident (when they could have just as easily). I’ve seen any number of underhanded tactics used to shed as much responsibility as possible, and a driver left holding a citation in his hand after an accident doesn’t change this. Anticipating stiff resistance is the only way to prepared when you’re dealing with a trucking company.
