PLOVER, WI — One person was taken to the hospital after a tractor-trailer and an SUV collided in Plover, Wisconsin on Wednesday, October 22nd, 2014. The article released by The Stevens Point Journal mentioned that the accident happened around 8:15.
Police said that an as-of-yet unidentified 72-year-old man was hurt when the vehicle he was driving and a tractor-trailer collided at the intersection of Highway 54 and Harding Avenue. The police said that the truck pulled out in front of the man’s SUV from Harding when the two collided.
The 72-year-old driver was taken by EMS to a nearby hospital after the accident.
The driver of the tractor-trailer was cited for failure to yield.
The Wisconsin State Police is investigating the crash.

The news said specifically that the truck driver pulled out in front of the victim’s car, and that they were cited with failure to yield after the crash. This probably means that the trucking company is going to throw up their hands and make amends for this accident, right? Wrong. In my 25 years of handling these types of cases, I’ve never once witnessed a trucking company put up zero resistance in fixing the damages from an accident. Even when their driver is obviously at fault, they’re going to defend every dollar of their bottom line, and they’ve become quite good at it over the years. They’ll try to say that the victim was speeding, that they were not paying attention, and that they could have avoided the accident (when their driver could have as well, no less). While it does not hurt the case to have a driver cited after an accident, it by no means makes it an unsinkable case. I’ve seen people go head long into an accident like this alone, only to be chewed up and spit out by the near-limitless resources these trucking companies wield, and people need to know what they’re getting into so they can protect themselves.
