Commentary:

The news mentioned that the accident happened at around 4:00 in the morning, and that alcohol was involved. Bars in Texas are required to stop serving alcohol and shut down at 2:00 in the morning. Now, there have been numerous cases I’ve seen where people were drinking at bars long after the law permits. While I cannot definitively say if these people were drinking at a bar after closing time, I can say it is a very real possibility that happens much more frequently than you’d think. If these people were at a bar after it was supposed to close and the bar skirted that regulation, is it outside the realm of possibility that the bar ignored other laws and over-served the driver too? The driver is probably going to face some harsh penalties from the state (as he should), but should the bar really continue business as usual after shirking regulations that are put on the books for no other reason than safety? Believe it or not, it is up to the victims in accidents to hold bars accountable for the role they played in the crash, and lawmakers outfitted Texans with the ability to do this with liquor liability laws.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
